Please read these terms carefully. By using our website or services, you agree to be bound by them.

These Terms & Conditions ("Terms") are a binding agreement between you and The Welcome Center Foundation, a Florida 501(c)(3) nonprofit organization ("Welcome Center", "we", "us", or "our"), and govern your access to and use of thewelcomecenter.org(the "Site") and any programs, content, forms, uploads, donations, communications, or services we make available (collectively, the "Services"). If you do not agree, do not use the Services.

1. Eligibility and acceptable use

You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the Services. You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not:

  • Submit false, misleading, fraudulent, or impersonating information.
  • Upload malware, viruses, or attempt to disrupt, probe, or reverse-engineer the Site or its infrastructure.
  • Attempt unauthorized access to accounts, data, systems, or networks.
  • Scrape, crawl, harvest, or use automated means to access the Services without our written consent.
  • Violate any applicable law, regulation, or third-party right (including intellectual-property, privacy, or publicity rights).
  • Harass, threaten, or defame any person, including staff, volunteers, or clients.

2. Informational purpose only — no legal or tax advice

Content on the Site, including articles, FAQs, blog posts, videos, and forms, is provided for general informational purposes only and is not legal, immigration, tax, financial, or professional advice. Immigration and tax laws change frequently and depend on individual circumstances. You should consult a qualified attorney, accredited representative, or tax professional regarding your specific situation.

3. No attorney-client relationship

Submitting a form, sending an email, uploading documents, scheduling a consultation, or otherwise contacting us does not create an attorney-client relationship, a tax preparer-client relationship, or any other professional relationship. A representation or service relationship exists only after: (a) we conduct a conflicts check, (b) you and the Welcome Center execute a written engagement or service agreement, and (c) any required fees or retainers are paid. Do not send time-sensitive or confidential information until a written engagement is in place.

4. Fees, appointments, and refunds

  • Fees for services are published on our Pricing page and may change without notice; the fee in your signed engagement controls.
  • Consultation fees are typically non-refundable once the consultation has been provided.
  • Government filing fees, biometrics, translations, courier, and third-party costs are separate and non-refundable.
  • Missed or late-cancelled appointments may forfeit any advance fee paid.
  • Fee waivers or reductions are granted only under our written policy and where eligible.

5. Donations

Donations are processed by third-party providers (e.g., PayPal). Donations to The Welcome Center Foundation are generally tax-deductible to the extent permitted by U.S. law; consult your tax advisor. Except as required by law, donations are final and non-refundable. If you believe a donation was made in error or without authorization, contact hello@thewelcomecenter.org within 30 days; refund decisions are at our discretion. Recurring donations continue until you cancel.

6. Document uploads and confidentiality

Documents you upload through our secure portal are used to evaluate eligibility and, where applicable, to deliver services. You represent that you have the right to share the documents you submit and that the information is accurate. We treat submitted documents as confidential and disclose them only as needed to provide Services or as required by law.

7. Intellectual property

The Site and its content — including text, graphics, logos, marks, images, video, code, and design — are owned by or licensed to the Welcome Center and are protected by U.S. and international intellectual-property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, publicly display, or create derivative works without our prior written consent.

8. User submissions

By submitting content to the Site (e.g., testimonials, comments, form responses), you grant us a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, adapt, and display such content in connection with our mission and Services. You represent that your submission does not violate any law or third-party right. We may remove any content at our discretion.

9. Third-party links and services

The Site links to and integrates with third-party sites and tools (e.g., PayPal, HubSpot, Encyro, YouTube). We do not control and are not responsible for third-party content, availability, or practices. Your use of third-party services is governed by their terms and policies.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, THE WELCOME CENTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT ANY PARTICULAR OUTCOME, INCLUDING IMMIGRATION, TAX, EDUCATIONAL, OR FINANCIAL RESULT.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE WELCOME CENTER, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US $100. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Welcome Center and its directors, officers, employees, volunteers, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) any content you submit.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive, including intellectual-property, disclaimers, limitation of liability, indemnification, and governing law.

14. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. You and the Welcome Center agree that any dispute arising out of or relating to the Services or these Terms will be brought exclusively in the state or federal courts located in Broward County, Florida, and each party consents to personal jurisdiction and venue there.

15. Informal resolution

Before filing any claim, you agree to try to resolve the dispute informally by contacting us at hello@thewelcomecenter.org. If we cannot resolve the dispute within 60 days, either party may pursue formal proceedings.

16. Class-action waiver

To the fullest extent permitted by law, you and the Welcome Center agree that each may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative action.

17. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, government actions, labor disputes, or infrastructure failures.

18. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted with a new effective date. Continued use of the Services after changes constitutes acceptance of the updated Terms.

19. Miscellaneous

These Terms, together with our Privacy Policy and any signed engagement, constitute the entire agreement between you and the Welcome Center regarding the Services and supersede prior agreements on that subject. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them freely.
